Court documents filed by the Michael Jackson Estate request public arbitration against HBO. What is the basis? – The contract itself requires public arbitration based on the public nature of the disparaging remarks. The Estate also specified that public arbitration avoids any HBO spin by the company of allegations that they wish to keep the case proceedings a secret.
In court filings the Estate wrote: “The Jackson Estate expressly requests that HBO agree to a public arbitration. Indeed, the Robson and Safechuck litigations were carried out in the public courts, and all of the false, graphic and detailed statements about how Jackson supposedly abused Robson and Safechuck which have caused such a stir in the press-were all available in the public records. Had HBO actually looked at the public records of the lawsuits, it would have discovered that, along with the fact that the credibility of Robson and Safechuck were absolutely devastated in the trial court. “
